Mais avant de passer \u00e0 l&rsquo;acte, il est important de se renseigner. Elke Hanel-Torsch, pr\u00e9sidente de l&rsquo;association des locataires de Vienne, sait ce qu&rsquo;il faut faire pour r\u00e9silier un appartement.  <\/em><\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-was-muss-ich-bei-der-kundigung-eines-befristeten-mietvertrags-beachten\"><strong>A quoi dois-je faire attention lorsque je r\u00e9silie un contrat de location \u00e0 dur\u00e9e d\u00e9termin\u00e9e ?<\/strong><\/h3>\n\n<p>Dans le cas d&rsquo;un logement \u00e0 dur\u00e9e d\u00e9termin\u00e9e, le bail prend en principe fin \u00e0 l&rsquo;expiration de la dur\u00e9e d\u00e9termin\u00e9e. Toutefois, un bail \u00e0 dur\u00e9e d\u00e9termin\u00e9e peut \u00eatre r\u00e9sili\u00e9 avant son terme &#8211; mais seulement apr\u00e8s la fin de la premi\u00e8re ann\u00e9e. \u00ab\u00a0Cela vaut \u00e9galement pour le renouvellement des contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e\u00a0\u00bb, pr\u00e9cise Hanel-Torsch. Ensuite, le contrat de location peut \u00eatre r\u00e9sili\u00e9 pour le dernier jour du mois en respectant un pr\u00e9avis de trois mois. \u00ab\u00a0Seule la r\u00e9ception de la r\u00e9siliation par la g\u00e9rance ou le bailleur compte pour les d\u00e9lais\u00a0\u00bb, pr\u00e9cise l&rsquo;experte en droit de la location. La lettre de r\u00e9siliation doit donc \u00eatre envoy\u00e9e \u00e0 temps pour ne pas perdre un temps pr\u00e9cieux.     <\/p>\n\n<p><em>Attention : si le bien lou\u00e9 \u00e0 dur\u00e9e d\u00e9termin\u00e9e <strong>n&rsquo;est pas <\/strong>soumis \u00e0 la loi sur le bail ou \u00e0 la WGG (Wohnungsgemeinn\u00fctzigkeitsgesetz) et que rien n&rsquo;a \u00e9t\u00e9 pr\u00e9vu dans le contrat de location en vue d&rsquo;une r\u00e9siliation anticip\u00e9e, le contrat de location n&rsquo;expire effectivement qu&rsquo;\u00e0 la fin de la dur\u00e9e du contrat.  <\/em><\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wann-muss-das-befristete-mietverhaltnis-nun-genau-gekundigt-werden\"><strong>Quand faut-il r\u00e9silier le bail \u00e0 dur\u00e9e d\u00e9termin\u00e9e ?<\/strong><\/h3>\n\n<p>Par exemple, si un bail de trois ans a \u00e9t\u00e9 conclu le 1.2.2024, il ne peut \u00eatre r\u00e9sili\u00e9 qu&rsquo;\u00e0 partir du 28.2.2025. Le bail se termine donc fin mai. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-was-gilt-fur-die-kundigung-unbefristeter-mietvertrage\"><strong>Qu&rsquo;en est-il de la r\u00e9siliation des contrats de location \u00e0 dur\u00e9e ind\u00e9termin\u00e9e ?<\/strong><\/h3>\n\n<p>Si vous souhaitez r\u00e9silier un contrat de location \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, la premi\u00e8re chose \u00e0 faire est de jeter un coup d&rsquo;\u0153il au contrat de location. \u00ab\u00a0En g\u00e9n\u00e9ral, on y trouve les d\u00e9lais de r\u00e9siliation. La plupart du temps, il s&rsquo;agit \u00e9galement de trois mois pour le dernier jour du mois\u00a0\u00bb, explique Hanel-Torsch. Si le locataire et le propri\u00e9taire n&rsquo;ont rien convenu \u00e0 ce sujet, le d\u00e9lai de pr\u00e9avis l\u00e9gal s&rsquo;applique &#8211; il est d&rsquo;un mois. Ainsi, si un appartement a \u00e9t\u00e9 lou\u00e9 le 1er septembre et qu&rsquo;un pr\u00e9avis de trois mois a \u00e9t\u00e9 convenu pour le dernier jour du mois, le bail se termine fin d\u00e9cembre. L\u00e0 encore, seule la r\u00e9ception de la r\u00e9siliation par la g\u00e9rance ou le bailleur compte pour les d\u00e9lais.       <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-gibt-es-die-moglichkeit-die-kundigungsfristen-zu-verkurzen\"><strong>Existe-t-il une possibilit\u00e9 de r\u00e9duire les d\u00e9lais de pr\u00e9avis ?<\/strong><\/h3>\n\n<p>En principe, la r\u00e9duction des d\u00e9lais de pr\u00e9avis est soumise \u00e0 l&rsquo;accord du bailleur. Ce n&rsquo;est que dans de tr\u00e8s rares cas que l&rsquo;ABGB pr\u00e9voit \u00e9galement la r\u00e9siliation du bail en dehors du d\u00e9lai de pr\u00e9avis. \u00ab\u00a0C&rsquo;est le cas lorsque l&rsquo;objet lou\u00e9 est devenu inutilisable sans que le locataire en soit responsable, par exemple en raison d&rsquo;une inondation\u00a0\u00bb, explique Hanel-Torsch.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wie-sieht-es-aus-wenn-der-mieter-stirbt\"><strong>Qu&rsquo;en est-il en cas de d\u00e9c\u00e8s du locataire ?<\/strong><\/h3>\n\n<p>Le contrat de location doit \u00e9galement \u00eatre r\u00e9sili\u00e9 dans ce cas. Si une personne autoris\u00e9e \u00e0 entrer dans le logement ne souhaite pas non plus continuer \u00e0 l&rsquo;utiliser, elle doit en informer le gestionnaire immobilier dans les 14 jours suivant le d\u00e9c\u00e8s du locataire. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wie-schreibe-ich-die-kundigung-der-wohnung-richtig\"><strong>Comment r\u00e9diger correctement la r\u00e9siliation du bail d&rsquo;un logement ?<\/strong><\/h3>\n\n<p>La r\u00e9siliation doit se faire par \u00e9crit, de pr\u00e9f\u00e9rence par lettre recommand\u00e9e. Hanel-Torsch conseille la formulation suivante : \u00ab\u00a0Par la pr\u00e9sente, je r\u00e9silie mon contrat de location en respectant le d\u00e9lai de pr\u00e9avis pour l&rsquo;appartement xy, de sorte qu&rsquo;il se termine le xx\u00a0\u00bb. Vous trouverez des mod\u00e8les de lettres de r\u00e9siliation sur le site Internet de l&rsquo;association des locataires<a href=\"https:\/\/mietervereinigung.at\/699\/Downloadcenter\">(https:\/\/mietervereinigung.at\/699\/Downloadcenter)<\/a> ou de la chambre de travail de Vienne<a href=\"https:\/\/wien.arbeiterkammer.at\/service\/musterbriefe\/wohnen\/miete\/Kuendigung_eines_Mietvertrages.html\">(https:\/\/wien.arbeiterkammer.at\/service\/musterbriefe\/wohnen\/miete\/Kuendigung_eines_Mietvertrages.html)<\/a>, entre autres.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-muss-ich-beim-wohnung-kundigen-noch-etwas-beachten\"><strong>Dois-je faire attention \u00e0 autre chose lorsque je r\u00e9silie mon appartement ?<\/strong><\/h3>\n\n<p>Outre les d\u00e9lais, les locataires qui souhaitent d\u00e9m\u00e9nager doivent penser \u00e0 documenter les relev\u00e9s de compteur ainsi que l&rsquo;\u00e9tat du logement. \u00ab\u00a0Nous conseillons aux locataires de prendre des photos de chaque pi\u00e8ce avant de rendre l&rsquo;appartement et de les dater. Des t\u00e9moins peuvent \u00e9galement \u00eatre utiles dans certaines circonstances\u00a0\u00bb, explique Hanel-Torsch. Les exceptions sont les demandes justifi\u00e9es du bailleur.
