Walter Rosifka, expert en droit du logement de la Chambre du travail de Vienne, vous explique ce que cela signifie. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wozu-dient-die-kaution\"><strong>\u00c0 quoi sert la caution ?<\/strong><\/h3>\n\n<p>La caution permet au bailleur de garantir ses cr\u00e9ances envers le locataire. Si le locataire ne paie pas son loyer ou si le propri\u00e9taire doit r\u00e9parer les dommages caus\u00e9s par le locataire apr\u00e8s son d\u00e9part, il peut utiliser la caution pour le faire. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wof-u-r-kann-der-vermieter-die-kaution-verwenden\"><strong>Wof<\/strong><strong>\u00fc<\/strong><strong>Comment le bailleur peut-il utiliser la caution ?<\/strong><\/h3>\n\n<p>D&rsquo;une part, la caution peut \u00eatre utilis\u00e9e pour payer les loyers impay\u00e9s et, d&rsquo;autre part, pour compenser les dommages caus\u00e9s par le locataire \u00e0 l&rsquo;objet lou\u00e9. Toutefois, le bailleur ne peut demander une indemnisation que pour les dommages qui d\u00e9passent l&rsquo;usure normale. Le calcul ne se base pas sur la valeur \u00e0 neuf, mais sur la valeur actuelle du meuble ou de la partie du logement endommag\u00e9.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-muss-man-immer-eine-kaution-zahlen\"><strong>Doit-on toujours payer une caution ?<\/strong><\/h3>\n\n<p>La loi n&rsquo;oblige pas les locataires \u00e0 payer une caution. En m\u00eame temps, il n&rsquo;est pas interdit aux propri\u00e9taires d&rsquo;en exiger un. Dans ce cas, cela doit toutefois \u00eatre stipul\u00e9 dans le contrat de location. Dans le cas contraire, le locataire n&rsquo;est pas tenu de verser une caution.     <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wie-hoch-darf-die-kaution-sein\"><strong>Quel peut \u00eatre le montant de la caution ?<\/strong><\/h3>\n\n<p>Il n&rsquo;y a pas de plafond l\u00e9gal pour la caution, son montant est donc une question de n\u00e9gociation. \u00ab\u00a0En r\u00e8gle g\u00e9n\u00e9rale, il s&rsquo;agit de trois mois de loyer brut\u00a0\u00bb, explique Walter Rosifka. La Cour supr\u00eame fixe le plafond du d\u00e9p\u00f4t de garantie \u00e0 six mois de loyer brut.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wann-ist-die-kaution-zu-bezahlen\"><strong>Quand la caution doit-elle \u00eatre pay\u00e9e ?<\/strong><\/h3>\n\n<p>Apr\u00e8s la signature du contrat de location. Selon ce qui a \u00e9t\u00e9 convenu, elle peut \u00eatre remise en esp\u00e8ces, mais aussi sous forme de livret d&rsquo;\u00e9pargne ou de garantie bancaire. Dans tous les cas, demandez une confirmation \u00e9crite de la remise de la caution.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-gibt-es-vorgaben-wie-diese-vom-vermieter-veranlagt-werden-muss\"><strong>Existe-t-il des directives sur la mani\u00e8re dont le bailleur doit le taxer ?<\/strong><\/h3>\n\n<p>Les bailleurs sont tenus de placer la caution au taux d&rsquo;int\u00e9r\u00eat de r\u00e9f\u00e9rence &#8211; que ce soit sur un livret d&rsquo;\u00e9pargne ou sous une autre forme de placement. Ce dernier doit toutefois offrir le m\u00eame taux d&rsquo;int\u00e9r\u00eat et la m\u00eame s\u00e9curit\u00e9 qu&rsquo;un livret d&rsquo;\u00e9pargne. Si c&rsquo;est le cas, il peut conserver le d\u00e9p\u00f4t de garantie \u00e0 hauteur de la cr\u00e9ance. Toutefois, le montant d\u00e9passant cette somme doit \u00eatre transf\u00e9r\u00e9 au locataire sortant.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wie-sieht-es-aus-wenn-der-vermieter-die-wohnung-verkauft\"><strong>Qu&rsquo;en est-il si le bailleur vend l&rsquo;appartement ?<\/strong><\/h3>\n\n<p>Dans ce cas, le nouveau propri\u00e9taire, et donc le nouveau bailleur, doit restituer la caution \u00e0 la fin du bail.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-was-passiert-wenn-der-vermieter-pleite-geht\"><strong>Que se passe-t-il si le bailleur fait faillite ?<\/strong><\/h3>\n\n<p>Comme nous l&rsquo;avons dit, le bailleur doit investir la caution s\u00e9par\u00e9ment de ses actifs. En cas d&rsquo;insolvabilit\u00e9, le locataire a le droit de distinguer le d\u00e9p\u00f4t de garantie. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-was-tun-wenn-der-vermieter-die-kaution-nicht-zur-u-ckzahlt\"><strong>Que faire si le bailleur ne paie pas la caution ?<\/strong><strong>\u00fc<\/strong><strong>rembourser ?<\/strong><\/h3>\n\n<p>S&rsquo;il ne donne pas de raison ou si le locataire estime qu&rsquo;elle n&rsquo;est pas valable, les locataires n&rsquo;ont d&rsquo;autre choix que d&rsquo;entamer une proc\u00e9dure de r\u00e9cup\u00e9ration de la caution aupr\u00e8s de l&rsquo;autorit\u00e9 de conciliation ou du tribunal d&rsquo;arrondissement concern\u00e9. Vous pouvez d&rsquo;ailleurs demander le remboursement de la caution jusqu&rsquo;\u00e0 30 ans apr\u00e8s la restitution du logement. Un conseil : prenez des photos de l&rsquo;appartement, tant \u00e0 l&rsquo;entr\u00e9e qu&rsquo;\u00e0 la sortie, afin de documenter son \u00e9tat.
