L&rsquo;\u00e9tat de ces derniers devient souvent un sujet de discorde.<\/em><\/p>\n\n<p>Les cartons de d\u00e9m\u00e9nagement s&#8217;empilent dans le nouvel appartement, l&rsquo;ancien est d\u00e9j\u00e0 vide. Il ne reste plus qu&rsquo;\u00e0 les restituer au bailleur ou \u00e0 son gestionnaire immobilier qui, en \u00e9change, versera la caution d\u00e9pos\u00e9e sur le compte du locataire sortant. Mais il arrive que cette \u00e9tape ne se passe pas sans heurts. \u00ab\u00a0En principe, un locataire doit restituer le logement dans l&rsquo;\u00e9tat o\u00f9 il l&rsquo;a re\u00e7u, d\u00e9duction faite de toute trace d&rsquo;usure normale. Mais il arrive souvent que les bailleurs pr\u00e9sentent l&rsquo;usure normale comme une d\u00e9t\u00e9rioration. Dans ce cas, les locataires ne re\u00e7oivent pas de remboursement de la caution, ou alors beaucoup moins\u00a0\u00bb, explique Walter Rosifka, expert en droit du logement de la Chambre du travail. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-leidiges-thema-bohrlocher\"><strong>La question douloureuse des trous de forage<\/strong><\/h3>\n\n<p>Par exemple, les trous de per\u00e7age pour la fixation de bo\u00eetes de cuisine, de tringles \u00e0 rideaux, d&rsquo;\u00e9tag\u00e8res, de tableaux ou de porte-serviettes dans la salle de bain sont souvent \u00e9voqu\u00e9s. \u00ab\u00a0Si ces \u00e9quipements sont retir\u00e9s comme il se doit lors du d\u00e9shabillage, les trous de per\u00e7age laiss\u00e9s sont une usure normale\u00a0\u00bb, explique Rosifka. Il en va de m\u00eame pour les rayures sur le parquet. \u00ab\u00a0Les traces d&rsquo;utilisation ne sont pas des dommages\u00a0\u00bb, pr\u00e9cise l&rsquo;expert en droit du logement. Le protocole doit mentionner les noms du c\u00e9dant et du cessionnaire ainsi que la dur\u00e9e du bail. D&rsquo;autre part, il doit contenir une description pr\u00e9cise de l&rsquo;appartement et de la cave correspondante &#8211; y compris une liste d&rsquo;inventaire et une description de l&rsquo;\u00e9tat des sols, des murs, des portes, des fen\u00eatres, des installations sanitaires et, le cas \u00e9ch\u00e9ant, des meubles, des relev\u00e9s de compteur et du nombre de cl\u00e9s. \u00ab\u00a0Si vous n&rsquo;\u00eates pas d&rsquo;accord avec le protocole, vous ne devez pas le signer\u00a0\u00bb, a d\u00e9clar\u00e9 Rosifka. Il recommande \u00e0 cet \u00e9gard de constituer une telle documentation d\u00e8s la prise de possession du logement, afin de pouvoir mieux documenter les changements intervenus au cours de la location. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-ersatzanspruch\"><strong>Demande d&rsquo;indemnisation<\/strong><\/h3>\n\n<p>S&rsquo;il s&rsquo;agit d&rsquo;un dommage, le locataire sortant doit le rembourser au bailleur. Il ne peut toutefois facturer que la valeur actuelle, et non le prix du neuf, ou d\u00e9duire ce montant de la caution. Toutefois, le cas \u00e9ch\u00e9ant, le locataire sortant peut \u00e9galement demander de l&rsquo;argent au propri\u00e9taire lors de la remise du logement. Et ce, s&rsquo;il a consid\u00e9rablement am\u00e9lior\u00e9 l&rsquo;\u00e9tat du logement pendant la dur\u00e9e du bail. \u00ab\u00a0Mais cela ne vaut que si ces investissements sont indemnisables, encore efficaces et utiles et pas encore totalement d\u00e9valoris\u00e9s. Et il doit faire valoir son droit \u00e0 r\u00e9paration en temps voulu et par \u00e9crit\u00a0\u00bb, explique Rosikfa. Sont notamment consid\u00e9r\u00e9s comme indemnisables la construction ou la transformation de conduites d&rsquo;eau, d&rsquo;\u00e9clairage et de gaz, d&rsquo;un syst\u00e8me de chauffage ou d&rsquo;une installation sanitaire, la r\u00e9union de deux logements non standard et l&rsquo;augmentation de cat\u00e9gorie qui en r\u00e9sulte ou encore l&rsquo;installation de fen\u00eatres isolantes et\/ou insonorisantes ainsi que des mesures d&rsquo;isolation thermique.
