Pour que le pot soit rempli, la loi impose depuis juillet un montant minimum pour les r\u00e9serves pr\u00e9lev\u00e9es chaque mois.<\/p>\n\n<p>Si un bien immobilier doit faire l&rsquo;objet de divers travaux d&rsquo;entretien ou de r\u00e9novation, la copropri\u00e9t\u00e9 peut \u00eatre confront\u00e9e \u00e0 des co\u00fbts importants. Il suffit de penser aux mesures de d\u00e9carbonisation.<strong> <\/strong>Selon certaines \u00e9tudes, le co\u00fbt de cette op\u00e9ration peut atteindre 400 euros par m\u00e8tre carr\u00e9.  <\/p>\n\n<p>Afin de pouvoir faire face \u00e0 ces travaux et \u00e0 d&rsquo;autres travaux similaires, les syndicats de copropri\u00e9taires sont l\u00e9galement tenus de constituer des r\u00e9serves. \u00ab\u00a0Ils constituent l&rsquo;amortisseur financier des propri\u00e9taires pour financer les travaux d&rsquo;entretien et d&rsquo;am\u00e9lioration ou pour r\u00e9parer les d\u00e9g\u00e2ts\u00a0\u00bb, explique l&rsquo;avocate Valentina Philadelphy-Steiner. Cependant, jusqu&rsquo;\u00e0 pr\u00e9sent, les r\u00e9serves constitu\u00e9es n&rsquo;ont souvent pas \u00e9t\u00e9 suffisantes pour faire face aux co\u00fbts. \u00ab\u00a0Le l\u00e9gislateur a seulement parl\u00e9 d&rsquo;un montant &lsquo;raisonnable'\u00a0\u00bb, explique Philadelphy-Steiner.  <\/p>\n\n<p>Ainsi, par le pass\u00e9, les propri\u00e9taires (ou le gestionnaire de l&rsquo;immeuble) \u00e9taient libres de fixer eux-m\u00eames le montant de la r\u00e9serve minimale \u00e0 verser chaque mois. \u00ab\u00a0Il y avait deux points de vue \u00e0 ce sujet : Les uns ont fait preuve d&rsquo;\u00e9conomie et ne voulaient faire r\u00e9aliser que les travaux n\u00e9cessaires, tandis que les autres souhaitaient conserver le bien en bon \u00e9tat \u00e0 long terme\u00a0\u00bb, explique l&rsquo;avocate.<\/p>\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"768\" height=\"1024\" src=\"https:\/\/myhome.at\/wp-content\/uploads\/2023\/11\/pexels-kindel-media-7579206-768x1024.jpg\" alt=\"R&#xE9;serve minimale, immobilier, conseils\" class=\"wp-image-11652\" srcset=\"https:\/\/myhome.at\/wp-content\/uploads\/2023\/11\/pexels-kindel-media-7579206-768x1024.jpg 768w, https:\/\/myhome.at\/wp-content\/uploads\/2023\/11\/pexels-kindel-media-7579206-225x300.jpg 225w, https:\/\/myhome.at\/wp-content\/uploads\/2023\/11\/pexels-kindel-media-7579206-1152x1536.jpg 1152w, https:\/\/myhome.at\/wp-content\/uploads\/2023\/11\/pexels-kindel-media-7579206-1536x2048.jpg 1536w, https:\/\/myhome.at\/wp-content\/uploads\/2023\/11\/pexels-kindel-media-7579206-830x1107.jpg 830w, https:\/\/myhome.at\/wp-content\/uploads\/2023\/11\/pexels-kindel-media-7579206-1200x1600.jpg 1200w, https:\/\/myhome.at\/wp-content\/uploads\/2023\/11\/pexels-kindel-media-7579206-scaled.jpg 1920w\" sizes=\"(max-width: 768px) 100vw, 768px\" \/><figcaption class=\"wp-element-caption\">La r\u00e9serve minimale pour l&rsquo;immobilier est obligatoire depuis juillet 2022.<\/figcaption><\/figure>\n\n<h3 class=\"wp-block-heading\" id=\"h-seit-juli-2022-mindestrucklage-neu\"><strong>Depuis juillet 2022 : nouvelle r\u00e9serve minimale<\/strong><\/h3>\n\n<p>Face \u00e0 la n\u00e9cessit\u00e9 de g\u00e9rer la transition \u00e9nerg\u00e9tique, le l\u00e9gislateur a r\u00e9agi en fixant, dans le cadre de l&rsquo;amendement de la loi sur la copropri\u00e9t\u00e9, une r\u00e9serve minimale qui est obligatoire depuis juillet 2022. Il est de 90 cents par m\u00e8tre carr\u00e9 de surface utile et par mois. Tous les deux ans, la r\u00e9serve minimale est valoris\u00e9e \u00e0 l&rsquo;aide de l&rsquo;IPC, et sera ajust\u00e9e pour la premi\u00e8re fois au 1er janvier 2024.  <\/p>\n\n<p>Mais il y a aussi des exceptions : Selon le l\u00e9gislateur, la r\u00e9serve mensuelle minimale peut \u00eatre inf\u00e9rieure, \u00e0 savoir  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>en raison de l&rsquo;ampleur particuli\u00e8re de la r\u00e9serve d\u00e9j\u00e0 existante<\/li>\n\n\n\n<li>en raison d&rsquo;une construction ou d&rsquo;une r\u00e9novation r\u00e9cente du b\u00e2timent<\/li>\n\n\n\n<li>ou si, dans le cas d&rsquo;un ensemble de maisons mitoyennes ou individuelles, les copropri\u00e9taires ont assum\u00e9 par contrat l&rsquo;obligation d&rsquo;entretien conform\u00e9ment \u00e0 l&rsquo;article 28, paragraphe 1, point 1, de la loi sur la propri\u00e9t\u00e9 fonci\u00e8re (parties g\u00e9n\u00e9rales de l&rsquo;immeuble, r\u00e9paration de dommages graves dans un objet de copropri\u00e9t\u00e9).<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-kredit-ohne-grundbuch\"><strong>Cr\u00e9dit sans registre foncier<\/strong><\/h3>\n\n<p>Il est bien entendu possible de continuer \u00e0 constituer une r\u00e9serve plus importante. Par exemple, lorsque d&rsquo;importants travaux de r\u00e9novation sont pr\u00e9vus dans les ann\u00e9es \u00e0 venir. Qu&rsquo;il s&rsquo;agisse d&rsquo;une r\u00e9serve minimale ou d&rsquo;une d\u00e9rogation \u00e0 cette r\u00e8gle, il n&rsquo;en reste pas moins que les r\u00e9serves peuvent \u00eatre \u00ab\u00a0fructifi\u00e9es\u00a0\u00bb par le syndic ou le syndicat des copropri\u00e9taires sur un compte commun et ne peuvent \u00eatre utilis\u00e9es qu&rsquo;\u00e0 des fins sp\u00e9cifiques. Concr\u00e8tement, cela s&rsquo;applique aux travaux d&rsquo;entretien et d&rsquo;am\u00e9lioration ainsi qu&rsquo;\u00e0 la r\u00e9paration des dommages. Les r\u00e9serves doivent faire l&rsquo;objet d&rsquo;un d\u00e9compte annuel qui doit \u00eatre pr\u00e9sent\u00e9 par \u00e9crit \u00e0 tous les copropri\u00e9taires.<\/p>\n\n<p>Si les co\u00fbts des travaux d&rsquo;entretien et d&rsquo;am\u00e9lioration ne peuvent pas \u00eatre pay\u00e9s par le fonds de r\u00e9paration, la \u00ab\u00a0contribution sp\u00e9ciale\u00a0\u00bb, un montant unique, peut \u00eatre pr\u00e9lev\u00e9e. Un financement externe est \u00e9galement possible. Les gestionnaires immobiliers peuvent contracter un pr\u00eat pour le compte du syndicat des copropri\u00e9taires, pour lequel la banque n&rsquo;a pas besoin d&rsquo;\u00eatre inscrite au registre foncier.  <\/p>\n\n<p>Dans ce contexte, la nouveaut\u00e9 depuis juillet est que, en cas de financement \u00e0 cr\u00e9dit de travaux d&rsquo;entretien et d&rsquo;am\u00e9lioration, le gestionnaire de l&rsquo;immeuble peut donner aux copropri\u00e9taires la possibilit\u00e9 de couvrir la part qui leur incombe avec leurs propres liquidit\u00e9s. Un copropri\u00e9taire qui en fait usage n&rsquo;a donc en principe pas \u00e0 supporter de frais de cr\u00e9dit.<\/p>\n\n<p>D&rsquo;ailleurs, si un propri\u00e9taire vend son logement, il ne re\u00e7oit pas les provisions qu&rsquo;il a faites en vue de travaux futurs.
